Welcome to Spokane Party People. These Terms and Conditions ("Terms") govern your use of our services, including but not limited to Dart Drop, Party Crate rentals, and any other party rental experiences we offer (collectively, the "Services"). By booking a Service, agreeing to our waiver, or otherwise engaging with Spokane Party People, you agree to these Terms.
Spokane Party People is owned and operated by Gaines Capital LLC, a Washington limited liability company doing business as Spokane Party People ("we," "us," "our"). Please read these Terms carefully.
1.1 Booking Deposit. A single $100 booking deposit is required at the time of booking to reserve your date and equipment. This deposit serves two purposes:
1.2 Rental Balance. The remaining rental balance, after the $50 deposit credit in Section 1.1, is due at the time of delivery, prior to commencement of your party. We accept the payment methods listed on your quote. If the balance is not paid at delivery, we reserve the right to withhold equipment or cancel the rental, in which case the $100 booking deposit is forfeited under Section 2.
1.3 Equipment Security Deposit. The $50 equipment security portion of your booking deposit is held during your rental period and refunded to your original payment method within 5 business days after we pick up and inspect the equipment, provided the equipment is returned on time, complete, and free of damage beyond normal wear and tear. We are not in the business of profiting from equipment deposits; the security deposit exists to cover missing items, avoidable damage, and equipment that does not return.
1.4 Replacement Charges Beyond Security Deposit. If lost, missing, or damaged items exceed the $50 equipment security deposit, you authorize Spokane Party People to bill the difference at replacement cost using the payment method on file, after we have provided you with an itemized accounting and a reasonable opportunity to respond. Normal scuffs, worn darts, and small signs of regular play are expected and not chargeable.
1.5 Pricing. All prices are quoted in U.S. Dollars and do not include applicable sales tax unless otherwise stated. We reserve the right to adjust prices at any time, but confirmed bookings will be honored at the price quoted at the time of booking.
2.1 Reschedule Window (48+ hours). If you contact us more than 48 hours before your scheduled event, your $100 booking deposit will be transferred at no charge to any open date within 90 days of your original event date, subject to availability. The transferred deposit retains its $50 / $50 split (rental credit + equipment security) and applies to the rescheduled rental.
2.2 Cancellation Within 48 Hours. Cancellations or no-shows occurring within 48 hours of the scheduled event result in forfeiture of the $100 booking deposit. This is because we have already reserved equipment, scheduling, and delivery resources for your slot and may have turned away other bookings. The equipment security portion is included in the forfeited deposit because no rental will occur.
2.3 Weather-Related Reschedules. Weather-related reschedules are never penalized, even within the 48-hour window. If weather conditions may make your event unsafe or unenjoyable (heavy rain, sustained winds, hazardous roads, extreme cold, snow, etc.), contact us as early as possible and we will transfer your booking deposit to any open date within 90 days at no charge. You may also choose to proceed as planned if you have indoor space or are comfortable with the conditions; we will help you adapt the setup where appropriate. Spokane Party People reserves the right, in good faith, to delay or cancel delivery on weather grounds when conditions are unsafe for our staff or equipment, in which case Section 2.5 applies.
2.4 No-Refund Policy on Booking Deposits. The $100 booking deposit is non-refundable in cash; it is, however, fully transferable under Sections 2.1 and 2.3. The only circumstances under which a cash refund of the booking deposit will be issued are described in Section 2.5.
2.5 If We Cancel. If Spokane Party People cancels your booking for any reason on our side (illness, equipment failure, vehicle issues, etc.), you will, at your option, receive (a) a full refund of all amounts paid, including any portion of the rental balance and the entire $100 booking deposit, processed within 5 business days, or (b) a free reschedule to any mutually available date within 12 months.
2.6 Reschedules Within the 90-Day Window. A booking that has already been rescheduled once under Section 2.1 or 2.3 may generally be rescheduled again at our reasonable discretion, subject to availability. Repeated rescheduling may, at our discretion, require a refreshed quote or additional deposit if pricing or scope has changed.
3.1 Delivery. We will deliver equipment to your specified location within the agreed-upon timeframe. You (or an authorized adult 18+) must be available to receive the equipment, sign the waiver where required, and pay the rental balance. If we are unable to deliver because no authorized person is present, you may be charged a missed-delivery fee (typically equal to the equipment security portion of the deposit) at our reasonable discretion.
3.2 Pickup. We will pick up the equipment at the agreed-upon time. The equipment must be repacked according to the included guide and available at the pickup location. If equipment is not ready for pickup at the scheduled time, additional pickup-attempt or late-return fees may apply.
3.3 Service Area & Location Requirements. Delivery is available within our standard service area (Spokane, WA metro). You are responsible for ensuring that the delivery and pickup location is accessible and reasonably safe for our personnel and equipment. Please notify us in advance of any access restrictions (stairs, gates, HOA rules, parking limitations, parks/permits, etc.).
4.1 Care of Equipment. You are responsible for all equipment while it is in your possession from delivery through pickup. Please use the equipment only as intended and take reasonable care to prevent damage, loss, or theft. Equipment is designed for normal use within typical party conditions.
4.2 Normal Wear vs. Damage. Minor wear (a few lost darts, normal scuffing, small marks from regular play) is expected and is not considered damage. Significant or avoidable damage, including but not limited to broken blasters, torn targets, damaged barriers, water damage, ink/paint stains, animal damage, or items returned heavily soiled beyond normal cleaning, will be charged at full repair or replacement cost.
4.3 Lost or Missing Items. If any item is lost, missing, or not returned, you will be charged its full replacement cost. Missing-item charges first draw down the $50 equipment security; charges in excess are billed under Section 1.4.
4.4 No Modification. Do not modify, alter, paint, or deface any equipment. Modifications will be considered damage and will result in replacement charges.
5.1 Assumption of Risk. Participation in our Services involves physical activity and the use of equipment, including foam-dart blasters (such as Nerf®-brand and similar foam-projectile products), barriers, and accessories. By booking a Service, you acknowledge and assume all risks associated with such participation, including accidental injury, property damage, and other unforeseen events arising from active play.
5.2 Liability Waiver. All participants (or their parent or legal guardian, if the participant is under 18) must agree to a liability waiver before active play. The waiver releases Gaines Capital LLC DBA Spokane Party People, its owners, employees, and agents from any and all claims, demands, damages, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant or to any property belonging to the participant, while participating in our Services, except to the extent caused by our gross negligence or willful misconduct.
5.3 Parent/Guardian Supervision. All Services require at least one responsible adult (18+) to supervise the entire play period. The supervising adult is responsible for enforcing safety rules (including required eyewear), supervising minors, calling timeouts, and serving as the primary contact during the rental. Spokane Party People is not responsible for injuries or incidents resulting from the absence of, or failure of, the required adult supervision.
5.4 Indemnification. You agree to indemnify, defend, and hold harmless Gaines Capital LLC DBA Spokane Party People, its owners, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the equipment, your violation of these Terms, or any other conduct related to your booking, except to the extent caused by our gross negligence or willful misconduct.
5.5 Limitation of Liability. To the fullest extent permitted by law, Spokane Party People shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services or equipment. Our total liability under these Terms shall not exceed the total amount you actually paid Spokane Party People for the specific Service giving rise to the claim.
6.1 Safe & Respectful Conduct. All participants must conduct themselves in a safe, respectful, and lawful manner. Spokane Party People reserves the right to refuse service or terminate an event without refund if participants engage in unsafe, illegal, harassing, or otherwise inappropriate behavior.
6.2 Compliance with Safety Rules. All participants must follow safety rules and instructions provided by Spokane Party People, including the eyewear-required rule for any foam-dart play. Failure to comply with safety rules may result in immediate termination of the event without refund. Our full safety information is available at https://spokanepartypeople.com/safety.
7.1 Privacy Policy. Your privacy matters. Please review our Privacy Policy to understand how we collect, use, and protect your information.
7.2 Communications & Consent. By providing your email address and/or phone number during booking, you consent to receive transactional communications from Spokane Party People relating to your booking, confirmations, reminders, delivery coordination, and follow-up. Promotional or marketing communications require separate opt-in. You may opt out of promotional emails at any time via the unsubscribe link, and you may opt out of promotional text messages by replying STOP to any message. Standard message and data rates may apply.
8.1 Modifications. We may modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of our Services after changes constitutes acceptance of the updated Terms. Material changes affecting confirmed bookings will not be applied retroactively without your consent.
8.2 Severability. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
8.3 Governing Law & Venue. These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Spokane County, Washington, and you and Spokane Party People consent to the exclusive jurisdiction and venue of such courts.
8.4 Entire Agreement. These Terms, together with your booking confirmation, any signed waiver, and our Privacy Policy, constitute the entire agreement between you and Spokane Party People regarding the Services, superseding all prior or contemporaneous agreements and understandings on the subject.
8.5 Trademarks. NERF® is a registered trademark of Hasbro, Inc. Spokane Party People is not affiliated with, endorsed by, or sponsored by Hasbro, Inc. We use Nerf®-brand blasters along with other foam-dart products as part of our independent party rental service.
